Delhi Court Reserves Judgment in Ex-WFI Chief Brij Bhushan Sexual Harassment Case

New Delhi: A Delhi court on Thursday reserved its judgment in the sexual harassment case lodged by six women wrestlers against former Wrestling Federation of India (WFI) chief and former BJP Lok Sabha MP Brij Bhushan Sharan Singh, bringing the trial that began two years ago to its final stage.Additional chief judicial magistrate Ashwini Panwar of Rouse Avenue Courts reserved the matter for Aug 3 after hearing the final arguments and directed both the prosecution and the defence to file written submissions within two weeks.The in-camera trial saw the prosecution examine 32 witnesses, including the six complainants, besides officials from the WFI and the Sports Authority of India (SAI). Senior advocate Rebecca John appeared for the complainants, while advocate Rajiv Mohan represented the defence.The court framed charges against Singh in May 2024 under Sections 354 (assault or criminal force to a woman with intent to outrage her modesty), 354A (sexual harassment) and 506(1) (criminal intimidation) of the Indian Penal Code (IPC). However, he was discharged in relation to the allegations made by one complainant. Co-accused and former WFI assistant secretary Vinod Tomar was charged under Section 506 Part I of the IPC for alleged criminal intimidation in connection with victim no. 1 and discharged of the remaining offences.The offences carry a maximum punishment of five years’ imprisonment.Earlier, the court dismissed Singh’s plea, seeking further investigation and permission to make additional submissions on the framing of charges. He had contended that he wasn’t in India on the date of one of the alleged incidents. Both Singh and Tomar are out on bail.The case stems from the protests launched by women wrestlers at Jantar Mantar in Jan 2023, alleging that Singh had sexually harassed multiple women wrestlers over several years. They demanded his arrest and removal from the federation. Singh, then BJP MP from Uttar Pradesh’s Kaiserganj, was subsequently removed as WFI chief, while Tomar was suspended.After the Union sports ministry assured the wrestlers that a committee would examine the allegations, the protests were briefly suspended before resuming in April 2023 over alleged inaction.Following the Supreme Court’s intervention, Delhi Police registered two FIRs on April 28, 2023. The present case is based on complaints by six adult women wrestlers, while a separate POCSO case arose from allegations by a minor wrestler. Both FIRs alleged incidents of sexual harassment between 2012 and 2022.
