<\/div>\n<\/div>\n<\/div>\n<\/section>\n<\/div><\/div>\n<\/div>\nNew Delhi:<\/span> Holding that a father\u2019s financial capacity must translate into a life of dignity and opportunity for his child, a Delhi court dismissed a husband\u2019s appeal challenging a Rs 50,000 monthly ad-interim maintenance order.Observing that \u201ca child does not choose the discord of her parents, yet bears its deepest consequences,\u201d additional sessions judge Anuj Agrawal ruled that the duty to provide persists regardless of the mother\u2019s financial independence. The appeal, filed by Gaurav Agarwal, was rejected, with the court finding the awarded amount reasonable and justified.The court also noted that the law not only steps in to resolve disputes between parties, but also ensures that \u201cthe child is not deprived of dignity, security, and opportunity.\u201d \u201cThe financial capacity of the father cannot remain a mere abstraction; it must translate into a life of reasonable comfort and development for the child who is his progeny,\u201d the court observed.The case arose from Gaurav Agarwal\u2019s challenge to a Feb 2026 order directing him to pay Rs 50,000 per month as ad-interim maintenance for his minor child. He argued that the amount was \u201cexcessive,\u201d citing his former spouse\u2019s financial independence and his own liabilities, while also raising issues such as inflated expenses and other disputes.The court, however, held that the impugned order was a purely \u201cad-interim arrangement\u201d passed at a preliminary stage to ensure the immediate sustenance of the child, with the main application for interim maintenance still pending. At this stage, it noted, only a prima facie assessment of financial capacity and the child\u2019s immediate needs is required, and not a detailed examination of contested facts.Referring to Gaurav\u2019s disclosed income of approximately Rs 3,27,093 per month, the court found the maintenance amount neither excessive nor disproportionate, noting that a child\u2019s needs \u201cextend beyond basic survival to include education, healthcare, and overall development.\u201d It further observed that while the mother\u2019s independent income is a relevant factor, it does not eclipse the father\u2019s obligation.<\/div>\n
