{"id":3820,"date":"2026-04-16T12:09:02","date_gmt":"2026-04-16T06:39:02","guid":{"rendered":"https:\/\/banitoday.com\/hc-gives-nod-to-use-comatose-soldiers-sperm-for-wifes-ivf-treatment-delhi-news\/"},"modified":"2026-04-16T12:09:02","modified_gmt":"2026-04-16T06:39:02","slug":"hc-gives-nod-to-use-comatose-soldiers-sperm-for-wifes-ivf-treatment-delhi-news","status":"publish","type":"post","link":"https:\/\/banitoday.com\/hi\/hc-gives-nod-to-use-comatose-soldiers-sperm-for-wifes-ivf-treatment-delhi-news\/","title":{"rendered":"HC gives nod to use comatose soldier\u2019s sperm for wife\u2019s IVF treatment | Delhi News"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<div class=\"e9jwa\">\n<div class=\"vdo_embedd\">\n<div class=\"GfdvZ\">\n<section class=\"_bIDB  clearfix id-r-component leadmedia undefined undefined  E9tg9 \" style=\"top:0px\">\n<div class=\"_bIDB\" data-ua-type=\"1\" onclick=\"stpPgtnAndPrvntDefault(event)\">\n<div class=\"ypVvZ\">\n<div class=\"WGttI\"><img src=\"https:\/\/static.toiimg.com\/thumb\/msid-47529300,imgsize-110164,width-400,height-225,resizemode-72\/47529300.jpg\" alt=\"HC gives nod to use comatose soldier\u2019s sperm for wife\u2019s IVF treatment\" decoding=\"async\" fetchpriority=\"high\"\/><\/div>\n<\/div>\n<\/div>\n<\/section>\n<\/div><\/div>\n<\/div>\n<p><span class=\"strong\" data-ua-type=\"1\" onclick=\"stpPgtnAndPrvntDefault(event)\">New Delhi: <\/span>Underlining the right to reproductive autonomy, <a href=\"https:\/\/timesofindia.indiatimes.com\/topic\/delhi-high-court\" styleobj=\"[object Object]\" class=\"\" commonstate=\"[object Object]\" frmappuse=\"1\">Delhi high court<\/a> has permitted the extraction and preservation of sperm of a comatose Army soldier, paving the way for his wife to undergo an IVF procedure to try for a child.<span class=\"id-r-component br\" data-pos=\"5\"\/>The soldier is in a persistent vegetative state with no foreseeable scope of neurological recovery. <span class=\"id-r-component br\" data-pos=\"7\"\/>In a recent order, Justice Purushaindra Kumar Kaurav noted that the soldier&#8217;s earlier consent, given when he started the IVF procedure, was sufficient even at this stage, and the nod of the wife would be treated as valid consent on his behalf for the purposes of the Assisted Reproductive Technology Act.<span class=\"id-r-component br\" data-pos=\"9\"\/>The high court acted on a petition by the wife seeking directions for extraction and cryopreservation of her husband&#8217;s genetic material for IVF. <!-- -->She said that in June 2023, the couple opted for an IVF procedure to conceive a child but in July 2025, the husband fell from a considerable height while patrolling, which resulted in severe traumatic brain injury. <span class=\"id-r-component br\" data-pos=\"14\"\/>Subsequently, while the soldier was undergoing treatment at an Army hospital, the IVF treatment of the couple was stopped, making her move court for relief. <span class=\"id-r-component br\" data-pos=\"16\"\/>Asserting her right to motherhood, dignity and reproductive autonomy under the Constitution, she sought HC\u2019s intervention. The court in its order pointed out that in any case, the couple had volunteered for the IVF treatment before his injury and there was no material on record or any indication to show that the husband had not consented. HC said it was only \u201cfair, reasonable, and just\u201d for the authorities to take steps to take the IVF procedure to its logical end.<span class=\"id-r-component br\" data-pos=\"20\"\/>\u201cIt is trite law, that procedure is indeed the handmaiden of justice. Non-compliance with the bare, strict text of a procedural provision, destroying the substantive intent of the legislation ought not to be countenanced. <!-- -->The right to reproductive autonomy must be remembered is a fundamental right. The ART Act must be so interpreted which furthers the said right, and not derogates from it,\u201d observed the court. <span class=\"id-r-component br\" data-pos=\"24\"\/>With respect to the opinion of the Army hospital\u2019s medical board that the possibility of retrieving viable sperm was \u201cmeagre\u201d in this case, the court said whether the wife would beget a child or not was \u201cnot in human hands\u201d. <span class=\"id-r-component br\" data-pos=\"26\"\/>\u201cIt is destiny that determines whether or not the fortune of parenthood shall get bestowed upon persons.
