{"id":27549,"date":"2026-06-27T19:03:22","date_gmt":"2026-06-27T13:33:22","guid":{"rendered":"https:\/\/banitoday.com\/bengal-uniform-civil-code-wont-apply-to-sts-says-samik-kolkata-news\/"},"modified":"2026-06-27T19:03:22","modified_gmt":"2026-06-27T13:33:22","slug":"bengal-uniform-civil-code-wont-apply-to-sts-says-samik-kolkata-news","status":"publish","type":"post","link":"https:\/\/banitoday.com\/hi\/bengal-uniform-civil-code-wont-apply-to-sts-says-samik-kolkata-news\/","title":{"rendered":"Bengal Uniform Civil Code won\u2019t apply to STs, says Samik | Kolkata News"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<div class=\"e9jwa\">\n<div class=\"vdo_embedd\">\n<div class=\"GfdvZ\">\n<section class=\"_bIDB  clearfix id-r-component leadmedia undefined undefined  E9tg9 \" style=\"top:0px\">\n<div class=\"_bIDB\" data-ua-type=\"1\" onclick=\"stpPgtnAndPrvntDefault(event)\">\n<div class=\"ypVvZ\">\n<div class=\"WGttI\"><img src=\"https:\/\/static.toiimg.com\/thumb\/msid-132035714,imgsize-7241538,width-400,height-225,resizemode-75\/pti05_29_2026_000501ajpg.jpg\" alt=\"Bengal Uniform Civil Code won\u2019t apply to STs, says Samik\" title=\"West Bengal BJP president Samik Bhattacharya\" decoding=\"async\" fetchpriority=\"high\"\/><\/div>\n<\/div>\n<\/div>\n<div class=\"Ta7d_ img_cptn\"><span title=\"West Bengal BJP president Samik Bhattacharya\">West Bengal BJP president Samik Bhattacharya<\/span><\/div>\n<\/section>\n<\/div><\/div>\n<\/div>\n<p>Kolkata: Scheduled Tribes (STs) will be kept out of the proposed Bengal <a href=\"https:\/\/timesofindia.indiatimes.com\/topic\/uniform-civil-code\" styleobj=\"[object Object]\" class=\"\" commonstate=\"[object Object]\" frmappuse=\"1\">Uniform Civil Code<\/a> (UCC), state <a href=\"https:\/\/timesofindia.indiatimes.com\/topic\/bjp\" styleobj=\"[object Object]\" class=\"\" commonstate=\"[object Object]\" frmappuse=\"1\">BJP<\/a> president and MP Samik Bhattacharya said on Saturday, asserting that their constitutionally protected customs, traditions and special rights would remain untouched.<span class=\"id-r-component br\" data-pos=\"7\"\/>Quoting a provision from the draft UCC on X, Bhattacharya said: \u201cNothing contained in this Code shall apply to the members of any Scheduled Tribes within the meaning of clause 25 of Article 366 read with Article 342 of the Constitution of India.\u201d<span class=\"id-r-component br\" data-pos=\"9\"\/>He said the exemption was in line with the BJP\u2019s commitment to protect the constitutional safeguards available to STs while introducing a common civil code for the rest of the population.<span class=\"id-r-component br\" data-pos=\"13\"\/>Outlining the party\u2019s position, Bhattacharya said the UCC would replace religion-based personal laws governing matters such as marriage, divorce, inheritance and adoption with a common legal framework to ensure equal rights and equal responsibilities for all citizens.<span class=\"id-r-component br\" data-pos=\"15\"\/>He added that the proposed law could also help end disparities arising from personal laws that permit polygamy, but clarified that it had nothing to do with limiting the number of children.<span class=\"id-r-component br\" data-pos=\"18\"\/>Bhattacharya said there was \u201cno hidden agenda\u201d behind the proposal and urged people not to be misled by what he described as attempts to create confusion over the UCC.<span class=\"id-r-component br\" data-pos=\"20\"\/>Under Article 342 of the Constitution, Bengal has 40 notified ST communities, which accounted for about 5.8% of the state\u2019s population in the 2011 Census.<span class=\"id-r-component br\" data-pos=\"22\"\/>The santhal community is the largest ST group in the state. Of the 40 communities, the Toto, Birhor and Lodha are classified as Particularly Vulnerable Tribal Groups (PVTGs).<span class=\"id-r-component br\" data-pos=\"25\"\/>The exemption for Scheduled Tribes is similar to the provisions in the UCCs enacted in Uttarakhand, Gujarat and Assam.<span class=\"id-r-component br\" data-pos=\"27\"\/>CM Suvendu Adhikari is expected to make a statement on the proposed UCC in the Bengal assembly on Monday. He has indicated that the state would constitute a committee headed by a retired judge, on the lines of Uttarakhand, Gujarat and Assam, to prepare a draft.<span class=\"id-r-component br\" data-pos=\"29\"\/>In Uttarakhand and Gujarat, the committees were headed by Justice (Retd) Ranjana Prakash Desai. <!-- -->The retired Supreme Court judge has also been appointed to head similar committees in Madhya Pradesh, Rajasthan and Chhattisgarh. In Assam, the committee was headed by Justice (Retd) Rumi Phookan, while Maharashtra has constituted a committee but is yet to announce its chairperson.<span class=\"id-r-component br\" data-pos=\"33\"\/>Despite Article 44 of the Constitution, which states that \u201cThe State shall endeavour to secure for the citizens a uniform civil code throughout the territory of India\u201d, and repeated observations by the Supreme Court\u2014from the Shah Bano case to the Sarla Mudgal and John Vallamattom judgments\u2014on the need for a UCC, the issue remains politically contentious in Bengal.<span class=\"id-r-component br\" data-pos=\"36\"\/>The proposal continued to draw sharp political reactions. Trinamool MP Saugata Roy described the UCC as a \u201ccommunal agenda\u201d, while Bengal Congress president Subhankar Sarkar said Bengal\u2019s strength lay in its diversity.<span class=\"id-r-component br\" data-pos=\"38\"\/>CPM\u2019s Brinda Karat questioned how a \u201cUniform\u201d Civil Code could exempt STs, arguing that India\u2019s diversity made such legislation neither necessary nor feasible. ISF MLA Nawsad Siddique said the proposal violated constitutional protections for religious and cultural rights.
