If such material was used, officials will assess whether parents were informed of their right to opt their children out of those lessons.<span class=\"id-r-component br\" data-pos=\"4\"\/> <\/p>\n<p><h2>Scope of the inquiry<\/h2>\n<\/p>\n<p> <span class=\"id-r-component br\" data-pos=\"8\"\/>The Justice Department said the investigations will review:<span class=\"id-r-component br\" data-pos=\"10\"\/> <\/p>\n<div class=\"cdatainfo modify_cdata_list_style id-r-component \" data-pos=\"12\">\n<ul>\n<li> Use of sexual orientation and gender identity content in classrooms <\/li>\n<li> Whether parental opt-out provisions were communicated <\/li>\n<li> Policies on transgender students\u2019 access to bathrooms, facilities and athletic teams <\/li>\n<\/ul>\n<\/div>\n<p> <span class=\"id-r-component br\" data-pos=\"14\"\/>Unlike earlier cases referred by the U.S. Department of Education, these investigations were initiated directly by the Justice Department.<span class=\"id-r-component br\" data-pos=\"18\"\/> <\/p>\n<p><h2>Federal position and statement<\/h2>\n<\/p>\n<p> <span class=\"id-r-component br\" data-pos=\"22\"\/>Assistant Attorney General Harmeet Dhillon said the department is focusing on parental awareness and school policies.<span class=\"id-r-component br\" data-pos=\"24\"\/> \u201cThis Department of Justice is determined to put an end to local school authorities keeping parents in the dark about how sexuality and gender ideology are being pushed in classrooms,\u201d Dhillon said in a statement on April 30.<span class=\"id-r-component br\" data-pos=\"26\"\/> She added that Supreme Court precedent affirms parental authority over children\u2019s education, including decisions on classroom content.<span class=\"id-r-component br\" data-pos=\"29\"\/> <\/p>\n<p><h2>Legal context<\/h2>\n<\/p>\n<p> <span class=\"id-r-component br\" data-pos=\"33\"\/>The investigations follow recent rulings by the U.S. Supreme Court, including:<span class=\"id-r-component br\" data-pos=\"35\"\/> <\/p>\n<div class=\"cdatainfo modify_cdata_list_style id-r-component \" data-pos=\"37\">\n<ul>\n<li> Mirabelli v. Bonta <\/li>\n<li> Mahmoud v. Taylor <\/li>\n<\/ul>\n<\/div>\n<p> <span class=\"id-r-component br\" data-pos=\"39\"\/>In Mirabelli v. Bonta, the court sided with parents challenging policies that restricted disclosure of students\u2019 gender identity to families. In Mahmoud v. Taylor, the court required school districts to allow parents to opt children out of lessons involving LGBTQ+ content, particularly for younger students.<span class=\"id-r-component br\" data-pos=\"41\"\/> <\/p>\n<p><h2>Districts and prior probes<\/h2>\n<\/p>\n<p> <span class=\"id-r-component br\" data-pos=\"45\"\/>The list of 36 districts under investigation does not include Chicago Public Schools.<span class=\"id-r-component br\" data-pos=\"48\"\/> Chicago Public Schools had previously been investigated by the Education Department\u2019s Office for Civil Rights under Title VI over a programme addressing outcomes for Black students.
